UN 안보리 결의 1325호

유엔안보리결의 1325호(S/RES/1325)는 2000년 10월 31일 만장일치로 통과되었다. 여성에 미치는 전쟁의 영향, 갈등해결과 지속가능한 평화를 만들기 위한 여성들의 기여를 특별히 담은 유엔 안전보장이사회 최초의 결의문이다. 아래는 그 결의문 국영문이다.

2000년 10월 3일 유엔안전보장이사회 제4213차 회의에서 본 결의문을 채택함


유엔 안전보장이사회는


의장의 관련 성명과 더불어 1999년 8월 25일자 유엔 안보리 결의 1261호(1999년), 1999년 9월 17일자 유엔 안보리 결의 1265호(1999년) 및 2000년 4월 20일자 1296호(2000년), 2000년 8월 11일자 1314호(2000년)를 상기하면서


또한 2000년 3월8일 여성 인권 및 국제 평화를 위한 유엔의 날 행사(United Nations Day for Women’s Rights and International Peace(국제 여성의 날))에서 언론에 발표한 의장 성명(SC/6816)을 상기하면서


또한 베이징 선언 및 행동 강령(Beijing Declaration and Platform for Action)(A/52/231)에서 정한 이행 조항뿐만 아니라 “2000년 여성: 21세기를 향한 성(性) 평등, 발전 및 평화”(Women 2000: Gender Equality, Development and Peace for the Twenty-First Century)(A/S-23/10/Rev.1)라는 제목으로 열린 유엔 총회 제23차 특별 회기 중, 특히 여성과 무력분쟁에 관한 결과 문건들을 상기하면서


유엔 헌장의 목적과 원칙 및 유엔 헌장에 준거하여 국제 평화와 안전 유지가 유엔 안보리의 주요한 책임임을 유념하면서

무력분쟁으로 인해 불리한 상황에 처한 이의 대다수가 국내외 난민을 포함한 민간인들, 특히 여성과 아동들이 상당수이며 전투대원 및 무장 대원들이 점차 이들을 희생 대상으로 삼고 있다는 점에 대해 우려를 표명하며 또한 이로 인해 항구적인 평화와 화해에 미치게 되는 영향을 인식하면서


분쟁 방지와 해결 및 평화구축과정에서 여성 역할의 중요성을 재확인하고 평화와 안전을 유지하고 촉진하려는 모든 노력에 여성들이 동등하게 참여하고 전적으로 개입하는 것이 중요하다는 점과 분쟁 방지와 해결에 관한 의사결정에 있어서 여성들이 할 수 있는 역할을 확대해야 한다는 필요성을 강조하면서


또한 분쟁 기간 및 분쟁 종결 후에 여성과 소녀들의 인권을 보호하고 있는 국제적 인도주의와 인권법을 전적으로 이행해야 한다는 필요성을 재확인하며


지뢰 제거와 지뢰 인식(대중 교육) 프로그램에서 여성과 소녀들을 특별히 고려하도록 모든 당사자들이 보장해야 한다는 점을 강조하며


평화 유지 활동에서 성인지적 관점의 주류화가 긴박하다는 필요성을 인식하며, 이 점에서 빈트후크 선언(Windhoek Declaration)과 다각적 평화지원 작전에서 성인지적 관점의 주류화에 대한 나미비아 행동 강령(Namibia Plan of Action on Mainstreaming a Gender Perspective in Multidimensional Peace Support Operations)(S/2000/693)을 주목하면서


또한 2000년 3월 8일 대(對) 언론 의장성명에서 수록한 분쟁 상황에 처한 여성과 아동 보호, 이들의 특별 요구사항 및 인권을 위해 일하는 모든 평화유지 인력에 대한 전문 교육에 대한 권고의 중요성을 인식하며


무력분쟁으로 인해 여성과 소녀들이 받는 영향력을 파악하고 효과적인 제도적 보완으로 이들을 보호하고 이들이 평화 프로세스에 전적으로 참여하는 것을 보장한다면 국제 평화와 안전을 유지하고 보급하는데 상당히 기여할 수 있다는 점을 인식하면서

무력분쟁으로 인해 여성과 소녀들에게 가해지는 영향력에 대한 자료를 강화해야 한다는 필요성에 주목하면서


1. 국가, 지역 및 기관 차원의 모든 의사결정 단계에 참여하는 여성 대표의 증원과 분쟁 예방, 관리 및 해결 메커니즘을 회원국이 보장 할 것을 촉구한다.


2. 분쟁해결 및 평화 과정의 의사결정 단계에서 여성 참여 증대를 요청한 전략적 행동 강령(A/49/587)을 사무총장이 이행할 것을 권장한다.


3. 유엔 사무총장은 자신을 대표하여 외교적 중재를 모색하기 위한 특별 대표단과 사절로 더 많은 여성을 지명할 것을 촉구한다. 이를 위해 회원국에게 정기적으로 주요 후보자 명단을 업데이트하여 추천하도록 할 것을 촉구한다.


4. 여성들이 유엔 현장기반 작전(United Nations field-based operations)에서, 특히 군 감시단, 민간 경찰, 인권 및 구호 인력으로 참여하여 더 많은 역할을 수행하고 기여할 수 있도록 유엔사무총장이 모색할 것을 더불어 촉구한다.


5. 평화 유지 작전에 성인지적(性認知的) 관점을 통합시키고자 하는 의지를 기꺼이 표명하며 적절한 경우에는 야전 작전에 성인지적 요소를 포함한다는 점을 유엔 사무총장이 보장해 줄 것을 촉구한다.


6. 모든 평화 유지 및 평화구축 조치에 여성의 개입이 중요하다는 것을 알리는 자료와 더불어 여성의 보호와 이들의 권리 및 특히 여성 특유의 요구사항에 대한 교육지침 및 자료를 유엔사무총장이 회원국에 제공해 줄 것을 요청한다. 그리고 회원국들은 자국의 군대와 민간 경찰 인력 배치 준비를 위한 교육 프로그램에 에이즈 바이러스 및 에이즈(HIV/AIDS)에 대한 교육을 통합할 것을 요청한다. 그리고 더 나아가서 평화유지 작전에 참여하는 민간 인력이 유사한 교육을 받을 수 있도록 유엔사무총장이 보장할 것을 요구한다.


7. 적절한 기금과 프로그램, 그 중에서도 유엔 여성 기금(United Nations Fund for Women)과 유엔 아동 기금(United Nations Children’s Fund)과 유엔난민 고등판무관실(Office of the United Nations High Commissioner for Refugees and other relevant bodies)을 통해 수행하는 훈련을 포함하여 회원국들이 자국의 성인지적 교육 노력에 대한 자발적인 재정지원과 기술 및 수송 지원을 증대할 것을 촉구한다.


8. 모든 관련 행위주체들이 평화 협정을 협상하고 이행할 때, 다음 사항을 포함한 성인지적 관점을 채택하도록 요구한다.


(a) 송환 및 재정착 기간 동안 재활과 복구(reintegration) 및 분쟁 후(後) 재건을 위해 여성과 소녀들이 원하는 특별 요구사항


(b) 현지 지역 여성들의 평화 방안 및 분쟁 해결을 위한 현지의 특정 처리 과정을 지원하는 조치 및 평화협정을 이행하는 모든 메커니즘에 여성들이 참여하도록 하는 조치


(c) 여성과 소녀들이 특히 헌법, 선거 제도, 경찰 및 사법부와 연계되었을 때 이들의 인권이 반드시 보호받고 존중 받을 수 있도록 보장하는 조치


9. 여성과 소녀들이 특히 민간인으로서 가지는 권리를 보호하는데 적용할 수 있는 국제법을 무력분쟁의 모든 당사자들이 전적으로 존중할 것을 요청한다. 특히 여성과 소녀들에게 적용 가능한 의무조항들은 다음에 근거한다. 1994년의 제네바 협정(Geneva Conventions of 1949)과 1977년의 부가 의정서(Additional Protocols thereto of 1977), 1951년의 난민 협약(Refugee Convention of 1951)과 1967년의 의정서(Protocol thereto of 1967), 1979년의 여성에 대한 모든 형태의 차별철폐에 관한 협약(Convention on the Elimination of All Forms of Discrimination against Women of 1979)과 1999년의 선택 의정서(Optional Protocol thereto of 1999), 1989년의 유엔 아동 권리 협약(United Nations Convention on the Rights of the Child of 1989)과 2000년 5월 25일자 선택 의정서(Optional Protocols thereto of 25 May 2000) 두 건이며 또한 무력분쟁의 당사자들이 국제 형사재판에 관한 로마규정(Rome Statute of the International Criminal Court)의 관련 조항을 유념할 것을 요청한다.


10. 무력분쟁의 모든 당사자들이 성 관련 폭력, 특히 강간 및 또 다른 형태의 성적 착취 그리고 무력분쟁 상황에서 벌어지는 모든 형태의 폭력에서 여성과 소녀들을 보호하는 특별 조치를 취할 것을 요청한다.


11. 처벌을 받지 않고 빠져나가는 상황(impunity)을 종식하고 집단 학살과 반인륜 범죄 및 전쟁 범죄를 저지른 이들에 대한 기소 책임을 모든 국가가 지고 있음을 강조한다. 여기에는 여성과 소녀들을 대상으로 저지른 성폭력 및 그 이외의 범죄들이 해당된다. 그리고 이런 관점에서 볼 때, 사면(赦免) 조항에 해당한다 하더라도 이런 범죄들은 그 대상에서 배제해야 함을 강조한다.


12. 무력분쟁의 모든 당사자들이 난민촌과 정착시설의 설계문제를 포함하여, 이런 시설들과 관련하여 민간인의 특성과 인도주의적인 면을 존중하고 또한 여성과 소녀들이 원하는 특별한 요구사항을 고려해 줄 것을 요청하며, 1998년 11월 19일자 유엔 안보리 결의 1208호(1998년)와 2000년 4월 19일자 결의 1296호(2000년)를 상기할 것을 요청한다.


13. 무장해제, 동원해제 및 복구 계획에 관여하는 모든 인력들은 여성과 남성 전직 전투 대원들이 원하는 상이한 요구사항과 더불어 이들의 부양가족이 원하는 요구사항도 고려할 것을 권고한다.


14. 유엔 안보리는 유엔 헌장 제41조에 의거하여 조치들이 채택될 경우에는 여성과 소녀들이 원하는 특별 요구사항을 유념하면서, 이러한 해당 조치들이 민간인들에게 끼치는 잠재적인 영향을 감안할 준비가 되어 있음을 재확인한다. 이는 적절한 인도적 면책사항을 고려하기 위해서이다.


15. 안전보장이사회는 지역 및 국제 여성 단체의 자문을 받는 것을 포함하여 성문제를 고려하고 여성의 인권을 고려하는 것이 임무임을 기꺼이 표명한다.


16. 무력분쟁으로 인해 여성과 소녀들이 받은 영향력과 평화 구축과정에서 여성들의 역할, 그리고 평화 프로세스와 분쟁 해결에 대한 성 관점(gender dimensions)에 관하여 연구를 수행할 것을 유엔 사무총장에게 요청한다. 더 나아가서 수행한 해당 연구 결과를 사무총장이 유엔 안전보장이사회에 보고서로 제출하고 이를 유엔 전체 회원국가에서 이용할 수 있도록 요청한다.


17. 유엔 안전보장이사회에서 보고할 때 적절한 경우라면 평화 유지 임무를 통한 성 주류화에 대한 진척상황과 더불어 여성 및 소녀들과 관련된 모든 다른 측면들도 포함시켜 줄 것을 유엔 사무총장에게 요구한다.


18. 본 사안을 적극적으로 다루어 나갈 것을 결정한다.



UNITED NATIONS SECURITY COUNCIL RESOLUTION 1325 ON WOMEN, PEACE AND SECURITY


The Security Council,

Recalling its resolutions 1261 (1999) of 25 August 1999, 1265 (1999) of 17 September 1999, 1296 (2000) of 19 April 2000 and 1314 (2000) of 11 August 2000, as well as relevant statements of its President and recalling also the statement of its President, to the press on the occasion of the United Nations Day for Women's Rights and International Peace of 8 March 2000 (SC/6816),

Recalling also the commitments of the Beijing Declaration and Platform for Action (A/52/231) as well as those contained in the outcome document of the twenty-third Special Session of the United Nations General Assembly entitled "Women 2000: Gender Equality, Development and Peace for the twenty-first century" (A/S-23/10/Rev.1), in particular those concerning women and armed conflict,

Bearing in mind the purposes and principles of the Charter of the United Nations and the primary responsibility of the Security Council under the Charter for the maintenance of international peace and security,

Expressing concern that civilians, particularly women and children, account for the vast majority of those adversely affected by armed conflict, including as refugees and internally displaced persons, and increasingly are targeted by combatants and armed elements, and recognizing the consequent impact this has on durable peace and reconciliation,

Reaffirming the important role of women in the prevention and resolution of conflicts and in peace-building, and stressing the importance of their equal participation and full involvement in all efforts for the maintenance and promotion of peace and security, and the need to increase their role in decision- making with regard to conflict prevention and resolution,

Reaffirming also the need to implement fully international humanitarian and human rights law that protects the rights of women and girls during and after conflicts,

Emphasizing the need for all parties to ensure that mine clearance and mine awareness programmes take into account the special needs of women and girls,

Recognizing the urgent need to mainstream a gender perspective into peacekeeping operations, and in this regard noting the Windhoek Declaration and the Namibia Plan of Action on Mainstreaming a Gender Perspective in Multidimensional Peace Support Operations (S/2000/693),

Recognizing also the importance of the recommendation contained in the statement of its President to the press of 8 March 2000 for specialized training for all peacekeeping personnel on the protection, special needs and human rights of women and children in conflict situations,

Recognizing that an understanding of the impact of armed conflict on women and girls, effective institutional arrangements to guarantee their protection and full participation in the peace process can significantly contribute to the maintenance and promotion of international peace and security,

Noting the need to consolidate data on the impact of armed conflict on women and girls,

1. Urges Member States to ensure increased representation of women at all decision-making levels in national, regional and international institutions and mechanisms for the prevention, management, and resolution of conflict;

2. Encourages the Secretary-General to implement his strategic plan of action (A/49/587) calling for an increase in the participation of women at decision-making levels in conflict resolution and peace processes;

3. Urges the Secretary-General to appoint more women as special representatives and envoys to pursue good offices on his behalf, and in this regard calls on Member States to provide candidates to the Secretary-General, for inclusion in a regularly updated centralized roster;

4. Further urges the Secretary-General to seek to expand the role and contribution of women in United Nations field-based operations, and especially among military observers, civilian police, human rights and humanitarian personnel;

5. Expresses its willingness to incorporate a gender perspective into peacekeeping operations and urges the Secretary-General to ensure that, where appropriate, field operations include a gender component;

6. Requests the Secretary-General to provide to Member States training guidelines and materials on the protection, rights and the particular needs of women, as well as on the importance of involving women in all peacekeeping and peace-building measures, invites Member States to incorporate these elements as well as HIV/AIDS awareness training into their national training programmes for military and civilian police personnel in preparation for deployment and further requests the Secretary-General to ensure that civilian personnel of peacekeeping operations receive similar training;

7. Urges Member States to increase their voluntary financial, technical and logistical support for gender-sensitive training efforts, including those undertaken by relevant funds and programmes, inter alia, the United Nations Fund for Women and United Nations Children's Fund, and by the United Nations High Commissioner for Refugees and other relevant bodies;

8. Calls on all actors involved, when negotiating and implementing peace agreements, to adopt a gender perspective, including, inter alia: (a) The special needs of women and girls during repatriation and resettlement and for rehabilitation, reintegration and post-conflict reconstruction; (b) Measures that support local women's peace initiatives and indigenous processes for conflict resolution, and that involve women in all of the implementation mechanisms of the peace agreements; (c) Measures that ensure the protection of and respect for human rights of women and girls, particularly as they relate to the constitution, the electoral system, the police and the judiciary;

9. Calls upon all parties to armed conflict to respect fully international law applicable to the rights and protection of women and girls as civilians, in particular the obligations applicable to them under the Geneva Conventions of 1949 and the Additional Protocols thereto of 1977, the Refugee Convention of 1951 and the Protocol thereto of 1967, the Convention Security Council - 5 - Press Release SC/6942 4213th Meeting (PM) 31 October 2000 on the Elimination of All Forms of Discrimination against Women of 1979 and the Optional Protocol thereto of 1999 and the United Nations Convention on the Rights of the Child of 1989 and the two Optional Protocols thereto of 25 May 2000, and to bear in mind the relevant provisions of the Rome Statute of the International Criminal Court;

10. Calls on all parties to armed conflict to take special measures to protect women and girls from gender-based violence, particularly rape and other forms of sexual abuse, and all other forms of violence in situations of armed conflict;

11. Emphasizes the responsibility of all States to put an end to impunity and to prosecute those responsible for genocide, crimes against humanity, war crimes including those relating to sexual violence against women and girls, and in this regard, stresses the need to exclude these crimes, where feasible from amnesty provisions;

12. Calls upon all parties to armed conflict to respect the civilian and humanitarian character of refugee camps and settlements, and to take into account the particular needs of women and girls, including in their design, and recalls its resolution 1208 (1998) of 19 November 1998;

13. Encourages all those involved in the planning for disarmament, demobilization and reintegration to consider the different needs of female and male ex-combatants and to take into account the needs of their dependants;

14. Reaffirms its readiness, whenever measures are adopted under Article 41 of the Charter of the United Nations, to give consideration to their potential impact on the civilian population, bearing in mind the special needs of women and girls, in order to consider appropriate humanitarian exemptions;

15. Expresses its willingness to ensure that Security Council missions take into account gender considerations and the rights of women, including through consultation with local and international women's groups;

16. Invites the Secretary-General to carry out a study on the impact of armed conflict on women and girls, the role of women in peace-building and the gender dimensions of peace processes and conflict resolution, and further invites him to submit a report to the Security Council on the results of this study and to make this available to all Member States of the United Nations;

17. Requests the Secretary-General, where appropriate, to include in his reporting to the Security Council, progress on gender mainstreaming throughout peacekeeping missions and all other aspects relating to women and girls;

18. Decides to remain actively seized of the matter."
